Insurance Disputes By State

Wyoming

In Wyoming, there are two main components that establish an insurer as acting in bad faith when it denies a claim. Firstly, it must be proven that there is no justifiable reason for the insurance company to deny the claim. Secondly, it must be shown that the insurer was fully aware of the absence of valid grounds for the claim denial.

Montana

Montana’s Unfair Claim Settlement Practices Act regulates the conduct of insurance companies in handling and settling insurance claims. The UCSPA is designed to protect policyholders and ensure fair treatment during the claims process. It outlines certain practices that are considered unfair or deceptive when performed by insurers.

The Montana law has 14 examples of unfair treatment, such as (1) misrepresenting pertinent facts or insurance policy provisions relating to coverages at issue; (2) fail to acknowledge and act reasonably promptly upon communications with respect to claims arising under insurance policies.
